Terms & Conditions
HavokArgo moves parcels between Malaysia and Uzbekistan, in both directions. These terms set out what we carry, what we will not carry, how long it takes, and what happens if something goes wrong.
01About these terms
These terms apply when you send a parcel with HavokArgo, or when you use this website. Please read them before you hand us a parcel. By sending a parcel with us, you accept these terms.
HavokArgo moves parcels between Malaysia and Uzbekistan, in both directions. “HavokArgo”, “we” and “us” in these terms mean the HavokArgo team. You can reach us at info@havokargo.com.
“You” means the person who sends the parcel. “Recipient” means the person who receives it in the destination country.
02What we do
We carry parcels between Malaysia and Uzbekistan only. We do not ship to or from any other country.
Your parcel travels in the checked baggage of a traveller who is already flying the route. We choose the traveller, and we may change who carries your parcel at any time without telling you first. We collect your parcel in Kuala Lumpur, hand it to a traveller, and receive it into our own facility in Tashkent, where the recipient collects it.
This means we are responsible to you for getting your parcel delivered. It also means we depend on flight schedules and on individual travellers, so we cannot promise exact dates. See section 7.
03How a shipment works
- 1You contact us with what you want to send.
- 2You bring the parcel to us, or we arrange collection.
- 3We weigh and measure the parcel and tell you the price.
- 4You pay in full.
- 5We dispatch the parcel with the next available traveller.
- 6When the parcel reaches our facility in Tashkent, we contact the recipient.
- 7The recipient collects the parcel, in person or by sending a taxi or courier.
We do not deliver to the recipient's door. Collection in Tashkent is arranged by the recipient, at their cost. See section 8.
04Items we do not accept
We accept most goods, but we will never accept the following. This is for the safety and the legal protection of the traveller carrying your parcel, who is an individual person and not a freight carrier.
- Alcohol
- Tobacco and tobacco products
- Drugs and narcotics of any kind
- Weapons, ammunition, explosives, fireworks
- Flammable liquids or gases, aerosols, corrosives, compressed gas
- Loose lithium batteries and power banks — banned from checked baggage by aviation rules
- Cash, gold, jewellery, precious stones
- Live animals, and human or animal remains
- Counterfeit goods
- Pornographic material, and material prohibited by the laws of either country
- Anything that needs a licence, permit or certificate that you do not hold — including medicines in quantity
Food, fruit, plants and seeds. We will consider carrying these, but they are the items most often refused at a border, and they can spoil on the way. If you send them, you do so at your own risk, you must check the rules under section 5 first, and we pay no compensation if they are refused, seized or spoil in transit.
If we find, or reasonably suspect, that a parcel contains any of the above, we may open and inspect it, refuse to carry it, hand it to the authorities, or dispose of it. We will not refund the shipping fee, and you are responsible for any fine, penalty or cost that results.
05Checking that your item is allowed
It is your responsibility to check that your item can legally be brought into the destination country. We do not check this for you and we cannot advise you on it. Import rules change often, and they cover ordinary goods as well as obvious ones — food, plants, fruit, medicines, cosmetics and electronics are all restricted in some form.
If your item is refused, seized, held or destroyed at the border because it was not allowed in, that is not our responsibility. We will not refund the shipping fee. See section 10 for what happens to the goods.
06Weight, price and payment
We price by weight. We quote in US dollars, and you may pay in local currency — Malaysian ringgit or Uzbek som — converted at the rate we apply on the day you pay.
How the price is set. We weigh and measure your parcel at our facility after we receive it, and then tell you the price. We charge on the greater of the actual weight and the volumetric weight, so a large light parcel is priced on the space it takes up.
Our measurement is final. If you told us a different weight, the weight we measure is the one that applies. If you disagree, we will send you a photograph of the parcel on the scale. We do not carry the parcel until the price is paid in full.
Payment is due before dispatch. We do not send parcels on credit, and we do not collect payment from the recipient.
Fragile and valuable items cost more. Fragile goods, medicines and valuable electronics — smartphones, laptops, tablets and cameras, for example — are carried at a separate, higher rate, because they need extra care in transit. We tell you the rate that applies to your parcel after we inspect it at the warehouse and before you pay.
If you do not accept the price, you may collect the parcel from our Kuala Lumpur facility within 3 days at no charge. After 3 days we treat it as abandoned (section 10).
Our price covers transport only. It does not include customs duties or taxes — see section 9.
07How long it takes
We dispatch your parcel with the next available traveller. This is usually 3 to 7 days after we receive it. Once the traveller has flown, delivery in Tashkent normally happens within 1 to 2 days of the flight landing.
These are estimates, not guarantees. We are not liable for late delivery, or for anything that happens because a parcel arrives later than expected. Delay can be caused by flight availability, a traveller cancelling or changing plans, baggage limits, customs inspection, border closures, public holidays, weather, or anything else outside our control.
If your parcel needs to arrive by a particular date, tell us before you pay, and do not rely on our estimate.
08Collection in Tashkent
When your parcel reaches our facility in Tashkent, we contact the recipient. They can collect it in one of two ways.
In person. They come to us, and they may open and check the parcel before taking it.
By taxi or courier. They arrange and pay for a driver to collect it from us.
When our responsibility ends. Our responsibility for the parcel ends the moment we hand it over — to the recipient, or to any driver, courier or other person they send. We do not choose that driver and we cannot be responsible for what happens after the parcel leaves us.
If the recipient does not confirm collection, the parcel is treated as delivered 48 hours after we notify them that it is ready.
Storage. We store the parcel free for 7 days after we tell the recipient it has arrived. After 7 days a daily storage fee applies, which we will tell you at the time. After 30 days we may treat the parcel as abandoned (section 10).
09Customs, duties and taxes
Your parcel travels as part of a traveller's personal baggage, and both Malaysia and Uzbekistan set limits on what a traveller may bring in without paying duty.
Our price covers transport only. Any customs duty, tax, fee, fine or inspection cost in either country is payable by you or the recipient, not by us. We do not advise on duties and we are not liable if they arise.
If a duty or charge is not paid, the parcel may be refused, held or destroyed by the authorities. We will not refund the shipping fee.
10Parcels that cannot be delivered
A parcel may be undeliverable because it was refused or seized at the border, because duty was not paid, because the recipient cannot be reached or refuses it, or because it was never collected within the periods in section 8.
In these cases the parcel is abandoned, and may be destroyed, disposed of or surrendered to the authorities, at your cost. We do not refund the shipping fee — we have already done the work of carrying it.
If sending it back is possible, we will help you do it — as a paid service, at your cost. Return carriage on this route is expensive, and often costs more than the goods are worth, so we will quote you before doing anything.
11Packing and declaring your parcel
You must pack your parcel properly. It travels in a suitcase, is handled by airport baggage systems, and will be pressed against other items. Pack it so it survives that: a rigid box, cushioning inside, and strong tape.
You must tell us what is inside. We ask you to declare the contents and their value before we accept the parcel. If you do not declare accurately, or you declare something different from what is inside, you lose the right to claim compensation, and you are responsible for any fine, delay or loss that results.
Fragile items. We do carry fragile things — electronics, glass, medicines — but they need extra care in transit, so they are priced at a separate rate (section 6). Tell us in advance if there is something breakable inside: we confirm acceptance and the rate once we have inspected the parcel at our warehouse. Pack it properly — and what we pay if it is damaged is set out in section 12.
12Our responsibility and the limit on compensation
If we lose your parcel, or it is damaged while we are responsible for it, we will pay compensation, up to a limit.
The limit is the lowest of these three amounts
- 1USD 12 for each kilogram of the parcel's gross weight; and
- 2USD 300 in total, for any one parcel, whatever it weighs; and
- 3the actual value of the contents, which you must prove with a receipt or invoice.
| Parcel | 12 × weight | Over the 300 cap? | Proven value | We pay |
|---|---|---|---|---|
| 2 kg | $24 | No | $500 | $24 |
| 2 kg | $24 | No | $15 | $15 |
| 10 kg | $120 | No | $600 | $120 |
| 25 kg | $300 | At the cap | $900 | $300 |
| 25 kg | $300 | At the cap | $80 | $80 |
For fragile and high-value items the limit is agreed separately. If you are sending electronics, medicines, documents, or anything worth more than the limits above, tell us before you pay. We will give you the limit for your parcel in writing together with the price — or decline to carry it. If we have not agreed a separate limit with you, the limits in this section apply, whatever the goods are worth.
We are never liable for:
- Anything that is not direct physical loss of or damage to the parcel — so no lost profit, lost business, missed occasions, or distress
- Delay, however it is caused (section 7)
- Anything that happens after we hand the parcel over in Tashkent (section 8)
- Goods that were not allowed into the destination country (section 5)
- Goods on the list in section 4
- Damage caused by poor packing (section 11)
- Damage or loss you did not report in time (section 13)
- Customs duties, taxes, fines and penalties (section 9)
- Anything outside our reasonable control — including flight cancellations, border closures, customs action, strikes, weather, and acts of government
Only one claim may be made per parcel, even if the parcel holds several items.
13Making a claim
There are two different deadlines, because the two problems need different proof.
Damaged parcel — report it at collection, before the parcel leaves us
We photograph every parcel as it leaves our facility. That photograph is our record of its condition.
If the recipient collects in person, they should open and check the parcel there, and report any damage before they leave. Once the parcel has left us, we cannot tell whether the damage happened in transit or afterwards, so no damage claim can be accepted.
If the recipient sends a taxi or courier instead of coming in person, the parcel is accepted in the condition shown in our photograph. If you want the parcel inspected before it is accepted, the recipient must collect in person.
Parcel never arrived — tell us within 30 days
You must report a lost or undelivered parcel within 30 days of the day you handed it to us. Our deliveries normally take about a week, so 30 days is ample time to notice. After 30 days we cannot accept a claim.
What every claim needs. Send claims to info@havokargo.com with:
- The date you handed us the parcel, and any reference we gave you
- A description of the contents
- Proof of the value — a receipt or an invoice
- Photographs, where there is damage
Without proof of value we cannot pay compensation, because the limit in section 12 depends on it.
We will look into the claim and respond within a reasonable time. If we pay a claim, that payment settles the matter in full.
